Acceptance of Terms

By using the DesPois website (despois.co) or purchasing any DesPois product, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our site or purchase our products.

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the site following any changes constitutes your acceptance of the revised terms.

Eligibility

You must be at least 13 years of age to use the DesPois website or purchase any DesPois product. By placing an order, you represent that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

Products & Editions

Each DesPois release is a limited, serialized collectible tied to a specific album era. Every release includes a collectible bottle, an album-era fragrance, and authenticated access to a Digital Album World. All three components are included in the purchase price and are delivered as a single ownership experience.

DesPois releases are produced in fixed edition quantities across six tiers: Black Original, Black Artist Signed, Gold Edition, Gold Artist Signed, Platinum Edition, and Platinum Artist Signed. The tier of bottle a buyer receives is determined by the serialized allocation of the production run. All tiers are offered at the same purchase price and include identical fragrance and Digital Album World access.

Edition allocation is fixed at the time of production and is never reprinted. Once an edition closes, it does not reopen. However, DesPois does hold the right to expand the collection as we see fit, i.e. for Artist tours for special edition releases

Preorders & Payment

DesPois releases are offered on a preorder basis. By placing a preorder, you are securing a serialized claim on a production run prior to manufacture and shipment.

• Charge timing. Your payment method is charged in full at the time your preorder is placed. This confirms your claim and secures your position in the production run.
• Fulfillment timeline. Estimated shipment timelines are stated on the product page at the time of preorder. DesPois will communicate proactively if any timeline changes occur.
• Pricing. All prices are listed in US dollars and are inclusive of the bottle, fragrance, and Digital Album World access. Applicable taxes and shipping costs are calculated at checkout.

Cancellations & Refunds

Because DesPois releases are produced in limited, serialized editions, our ability to accommodate cancellations is limited once production has commenced.

• Before shipment. If your order has not yet shipped, you may request a cancellation and full refund by contacting us at [email protected]. We will process eligible refunds within 10 business days.
• After shipment. Once your order has shipped, all sales are final. We do not accept returns or offer refunds on shipped orders, except in cases of damage or fulfillment error as described below.
• Damaged or incorrect items. If your bottle arrives damaged or you receive an incorrect item, contact us within 3 days of delivery with photos and your order details. We will work to resolve the issue promptly.

Digital Album World Access

Each DesPois bottle includes NFC-enabled authentication that unlocks access to a release-specific Digital Album World. This is an owner-only digital environment accessible exclusively to registered bottle owners.

• Registration required. To access the Digital Album World, you must register your bottle by tapping the NFC point on the object with a compatible device and creating or signing into a DesPois account. A fallback registration code is included in your packaging for devices without NFC support.
• One registration per bottle. Each bottle may only be registered to one DesPois account. Once registered, ownership is linked to that account.
• Access tied to ownership. Digital Album World access is granted to the registered owner of the physical bottle. DesPois does not guarantee continued access in the event of account termination due to a violation of these terms.
• Service availability. DesPois makes reasonable efforts to maintain Digital Album World access for the lifetime of each release. However, we reserve the right to modify, update, or discontinue features of the digital environment with reasonable notice to registered owners.
• No unauthorized sharing. Digital Album World access is personal and non-transferable. You may not share, sublicense, or sell access to your Digital Album World environment.

Intellectual Property

All content on the DesPois website — including text, design, graphics, logos, and the DesPois name and brand — is the property of DesPois and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any DesPois content without our express written permission.

Artist names, imagery, and associated content included in any DesPois release remain the intellectual property of the respective artist or rights holder. Purchase of a DesPois release does not grant any license to that artist's music, name, likeness, or associated intellectual property beyond personal, non-commercial enjoyment of the physical and digital product.

Secondary Market & Resale

DesPois releases are collectible objects and may be resold on secondary markets at the discretion of the owner. However, please note the following:

• Digital Album World access. Digital Album World access is currently linked to the original registered account and is not automatically transferable upon resale. DesPois may introduce an ownership transfer mechanism in the future.
• No endorsement. DesPois does not endorse, facilitate, or guarantee any secondary market transaction. We are not responsible for the condition, authenticity, or pricing of products sold through third-party platforms.
• Authentication. Each DesPois bottle carries a unique serial number and NFC chip that can be used to verify authenticity. DesPois makes no representations regarding the value of any release on secondary markets.

Prohibited Use

You agree not to use the DesPois website or services to:

• Violate any applicable law or regulation
• Misrepresent your identity or affiliation with any person or entity
• Attempt to gain unauthorized access to any part of the site or our systems
• Interfere with the proper functioning of the website
• Use automated tools to scrape, crawl, or extract data from the site without our permission
• Fraudulently claim ownership of a bottle you do not possess

Disclaimer of Warranties

The DesPois website and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, DesPois disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, DesPois shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or purchase of our products — including but not limited to loss of data, loss of profits, or damage to property.

Our total liability to you for any claim arising from these terms or your purchase shall not exceed the amount you paid for the relevant product.

Governing Law

These Terms of Service are governed by the laws of the United States and the state in which DesPois is incorporated, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the appropriate courts of that jurisdiction.
